Competition Terms & Conditions

KELLYVILLE PETS 10K FACEBOOK LIKES ‘GAME OF SKILL COMPETITION’

By entering this competition, entrants are deemed to agree to these terms and conditions.

Information on how to enter and the prize draw form part of these conditions of entry. Entry into the competition is deemed acceptance of these conditions of entry.
The Promoter is Petopia Pty Ltd trading as Kellyville Pets (ABN: 50 151 314 448) of 1-15 Millcroft Way, Beaumont Hills, NSW 2155.
The competition commences on Monday 13th of November 2017 at 00:01 (AEDT) and concludes on Sunday 17th of December, 2017 at 16:59 (AEST). Any entry received after the promotional period has closed will be deemed invalid.
The winner will be drawn at 1:00pm (AEST) at Kellyville Pets (1-15 Millcroft Way, Beaumont Hills, NSW, 2155) by a panel of judges on Wednesday 20th of December, 2017.
There will be a total of 1 winner at the end of the competition.
Entry is open to all residents of Australia who are 18 years of age or over. If the entrant is under 18 years old, you must have your parents’ permission to enter. Employees and their immediate families of the Promoter, participating outlets and their agencies associated with this promotion are ineligible.
Winner must have liked and be following the Kellyville Pets Facebook page (@kellyvillepets).
Winner will be notified through Facebook within 3 days of the draw. Prize-winners will be published on the Kellyville Pets Facebook page https://www.facebook.com/kellyvillepets once notified.
Upon receiving the notice, the Winner must respond to Kellyville Pets via Facebook to claim the prize within 3 months of the prize draw before a second chance prize draw be conducted.
Entry to the competition will be via the Kellyville Pets Facebook page. To enter the competition, entrants will need to post a photo on Facebook of themselves with Gary the Gorilla. Entrants will also be required to mention @kellyvillepets in the caption and use the hashtag “#kp10Kcomp”.
Submissions must be:
1. original and creative;
2. have both the entrant and Gary the Gorilla in the photo;
3. posted to Facebook, and the post be made public;
4. mention @kellyvillepets in the caption and #kp10Kcomp.
Photo submissions may contain more than one person, however the Entrant that posts the photo will be considered the sole winner.
The same photo cannot be submitted by several Entrants. The first submission of the photo will be considered the only valid entry.
The posted photo must be made public for judging. If the post remains on a private setting it will be deemed invalid for judging.
If any damage or mess is found on or around Gary the Gorilla the entry will be deemed invalid.
Entries must not contain content that is unlawful; fraudulent; breaches intellectual property, privacy, publicity or other rights; or defamatory; obscene; derogatory; pornographic; sexually inappropriate; violent; indecent; profane; abusive; harassing; threatening; or objectionable with respect to race, religion, origin or gender. Any entries breaching this condition will automatically be invalid.
In submitting entries, Eligible Participants must comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation and privacy.
Persons that do not comply with these terms and conditions will be disqualified and will not be considered eligible to take part in the Competition.
Entrants must own all rights to the photo submitted to the competition. The person making the entry warrants that the submission is their own work and not subject to copyright of another party. Entries must be free of claims that they infringe third party rights.
The Competition is a game of skill and chance plays no part in determining the winner. There will be 1 prize winner chosen by a panel of judges of the promoter, in its sole discretion, based on the creativity of the photo submitted.
By submitting a photo to Facebook with the mention of @kellyvillepets and #kp10Kcomp, you will go in the draw for a chance to win the following prize pack:
1. A year’s supply of Hill’s™ Science Diet™ dog or cat food of choice (maximum total value $1487.88*)
2. A Kong toy prize pack to the value of $242.73*
3. A Fuzzy Beast Studios voucher to the value of $330
4. A Kellyville Pets voucher to the value of $200
Total prize pool is up to $2260.61* in value.
The year’s supply of Hill’s™ Science Diet™ is limited to 12 bags total. The Winner is able to collect one bag only per month from Kellyville Pets. The winner may choose a bag from the standard Hill’s™ Science Diet™ range; this excludes prescription ranges and any line Kellyville Pets does not stock. Excludes wet food varieties.
A maximum limit of one prize will be awarded to any entrant whose valid entry is selected.
Prize value is in Australian dollars.
The Promoter reserves the right, subject to any applicable gaming authority approval, to substitute the prize with a prize of equal or greater value if the prize is for some reason unavailable.
It is the entrant’s responsibility to advise the Promoter of any change of personal details.
Winners must take the prize as offered. Once the prize has left the Promoter’s premises, the Promoter is no longer responsible for any late or misdirect prizes.
Entry is only open to Australian residents.
Employees, directors, management and any family members of the Promoter are excluded from entry.
Entrants can register for the competition as many times as they like, provided they submit an original photo for each entry.
Prizes are not transferable.
Winners may not exchange their prize for cash or other prizes.
The Promoter shall not be liable for any loss or damage whatsoever suffered during the course of this promotion or associated with delivery of the prize.
To the maximum extent permitted by law, the Promoter makes no representation or warranty as to the quality and/or suitability of the prize.
All personal information collected by the Promoter in relation to this competition will be collected, used and disclosed only for purpose of communicating with the winners of this competition in accordance with the Promoter’s Privacy Policy, available at https://www.kellyvillepets.com.au/pages/privacy-policy
The Promoter reserves the right to use winners’ names for promotional purposes only. All entries and information relating to the competition remain the property of the Promoter and can be used to further promote the brand and its associated products.
The Promoter is not responsible for any incorrect or inaccurate information, either caused by you or for any of the equipment or programming associated with or utilised in the competition, or for any technical error, or any combination thereof that may occur in the course of the administration of the competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorized access to or alteration of entries.
The Promoter is not responsible for lost, late, incomprehensible or incorrect entries in the competition. The Promoter also accepts no responsibility for any tax implications that may arise from prize winnings in the competition. You should seek independent financial advice about such matters.
In the event of war, terrorism, state of emergency, disaster or (without limitation) any other event outside our reasonable control, the promoter is entitled to cancel, terminate, modify or suspend the competition - subject to any written directions f7rom any applicable regulatory authority.
If for any reason the competition is not capable of running as planned (including but not limited to) technical failures, unauthorized intervention, fraud or any other causes beyond our control which corrupt or affect the administration, security, fairness, integrity or proper conduct of this competition, the promoter is entitled in our sole discretion to disqualify any individual who tampers with the entry process, and (subject to any written directions given by any applicable regulatory authority), to cancel, terminate, modify or suspend the competition.
The winners release the Promoter, and its related bodies corporate from any and all causes of action, losses, liability, damage, expense (including legal expenses) cost or charge suffered, sustained or in any way incurred by the winner as a result of any loss or damage to any physical property of the winner, or any injury to or death of any person arising out of, or related to, or in any way connected with the Promoter, the promotion or the prize.
The winner agrees to participate in any news media activities surrounding the promotion.
All customers who enter into the draw will automatically go onto the Kellyville Pets Pet Lovers database to receive newsletters.
If any winner of a prize has not contacted Kellyville Pets within 3 months of the prize draw to collect their prize, the Promoter will conduct a re-draw/second prize draw for that prize on or after at 11:00am (AEST) Saturday 17^th of March, 2017 at Kellyville Pets, 1-15 Millcroft Way, Beaumont Hills, NSW 2155, subject to any directions from any applicable regulatory authorities. The winner will be notified via Facebook by Kellyville Pets and winner will also be posted on the Kellyville Pets website. http://www.kellyvillepets.com.au
