In these Terms and Conditions, unless the context otherwise requires:

"Pet Lovers Club Member" or "Member" means a person who is enrolled in the Pet Lovers Club Loyalty Program.

"Loyalty Program" means the scheme called the Pet Lovers Club pursuant to which points are offered or made available to Kellyville Pets Pet Lovers Club Members from time to time as a result of the purchase of products or services from Kellyville Pets.

These Terms and Conditions may be changed, amended or varied at any time by Kellyville Pets in its absolute discretion without giving a reason and without notice.

A Member accepts these Terms and Conditions as amended from time to time and agrees to be bound by them. Membership in the Loyalty Program is subject to these Terms and Conditions as amended from time to time.

Any failure by a Member to adhere to these Terms and Conditions may result in termination of the Member's membership in the Loyalty Program and cancellation of accrued points.

Membership in the Loyalty Program is offered at the discretion of Kellyville Pets, and Kellyville Pets has the right to accept or reject any application for membership.

Only natural persons can become Pet Lovers Club Members. Membership cannot be held jointly, and a person may only hold one Pet Lovers Club membership. A Member's participation in the Loyalty Program will be resolved by Kellyville Pets in its sole discretion. All Members must be resident in Australia and at least 16 years of age.

Kellyville Pets is cardless — there is no physical or digital Pet Lovers Club card. A person wishing to join must provide their first name, last name, telephone number, postcode and a valid email address to Kellyville Pets at the time of sign-up.

A Member's account and point balance are identified and looked up in store using the Member's registered telephone number. As proof of membership, a Member must be able to provide their first name, last name and telephone number (and, if requested, postcode and email).

A valid email address must remain attached to a Member's account at all times in order for the Member to accrue and redeem points, and to be notified of point balances, vouchers, and upcoming promotions and events. Kellyville Pets is not responsible for any points, vouchers or notifications not received due to an out-of-date, invalid or unmonitored email address or telephone number. Each Member is responsible for advising Kellyville Pets of any change to their contact details, including telephone number, postcode and email address.

Kellyville Pets will use its reasonable endeavours to notify Members of matters of interest, including changes to the Loyalty Program, but will not be liable for failing to do so, or for correspondence lost or delayed in the mail or via email. Kellyville Pets may inform, advise and notify Members by any form of communication.

• Points will only be accrued on participating brands and suppliers.
• Points are non-transferable and have no cash or monetary value, and are not redeemable for cash.
• For the purpose of calculating the value of individual purchases, Pet Lovers Rewards Points are displayed based on whole dollars paid inclusive of GST, subject to the Member's account being verified at the time of purchase.
• A Member will be awarded one point for every dollar spent at Kellyville Pets on participating brands and suppliers.
• When a Member accumulates 500 points, they will receive an email notification stating they are entitled to a voucher to the value of $10.00 to be spent on their next visit. If a Member does not receive an email notification, cashiers will notify the Member at the time of purchase on their next visit.
• Points are not accumulated on the purchase of pets or livestock (including but not limited to dogs, cats, birds, fish and reptiles), or on gift card purchases.
• A Member who has provided Kellyville Pets with their date of birth in advance will receive 500 points on their birthday each year. Points will not be added retrospectively where a date of birth is provided after the Member's birthday has already passed.
• Where a Member obtains a refund or reimbursement for a purchase, the points previously accrued for that purchase will be cancelled.
• Redemption of points must be claimed by the Member personally.
• If there is no purchase activity on a Member's account for a continuous period of 90 days, any points accrued on that account will expire.

In addition to earning and redeeming points, membership in the Loyalty Program entitles Members to member-only pricing on selected products and promotions, as identified in store or online from time to time. Member pricing is offered at the discretion of Kellyville Pets and may be varied, restricted or withdrawn at any time without notice.

Pet Lovers Plus is an additional tier of the Loyalty Program. A Member is automatically upgraded to Pet Lovers Plus upon the purchase of a pet or an aquarium from Kellyville Pets (the "qualifying purchase").

To remain a Pet Lovers Plus Member, a Member must make at least 5 further purchases in each 12-month period, calculated on a rolling basis from the date of the qualifying purchase. If this requirement is not met, the Member will return to standard Pet Lovers Club membership, retaining all points accrued (subject to the 90-day inactivity expiry set out above).

Pet Lovers Plus Members receive 2 points for every $1 spent on eligible purchases (instead of the standard 1 point per $1), and receive 1,000 points on their birthday each year (instead of the standard 500 points), provided their date of birth has been given to Kellyville Pets in advance. Points will not be added retrospectively where a date of birth is provided after the Member's birthday has already passed.

By joining the Loyalty Program, Members consent to receive account-related communications by email and/or SMS regarding their points balance, vouchers and other Loyalty Program activity. These are necessary account communications and cannot be opted out of while remaining a Member.

Members may separately opt in or out of promotional and marketing communications (including notice of upcoming promotions and events) by email and/or SMS at any time, using the unsubscribe or preference options provided in each communication, or by contacting marketing@kellyvillepets.com.au. Opting out of marketing communications does not affect a Member's ability to accrue or redeem points.

Kellyville Pets' collection and handling of personal information for the Loyalty Program, including for marketing purposes, is set out in our Privacy Policy.

If Kellyville Pets identifies that a person holds more than one Pet Lovers Club account (for example, due to a change of telephone number or an error at sign-up), Kellyville Pets may merge those accounts into a single account. Any eligible points held across the duplicate accounts will be combined into the retained account; however, purchase history recorded against the retired account will not carry over and will be lost.

Kellyville Pets may terminate the Loyalty Program at any time. In the event of termination of the Loyalty Program, or cancellation of a Member's membership, Kellyville Pets will notify Members of such termination or cancellation. All accrued points must be redeemed within three (3) months of the date of termination or cancellation, whichever is sooner. Where a Member cancels their own membership, all accrued points will be forfeited.

Kellyville Pets will not be liable for any disruption to the Loyalty Program, or any delay to or inability to provide points, caused by circumstances beyond its control, including technical disruptions with our service providers.

• Kellyville Pets is not responsible for errors resulting from computer hardware or software errors or failure, nor for fraud.
• Kellyville Pets has the right to remove, subtract or cancel any Member's points at any time, without notice.
• Any questions regarding the Pet Lovers Club Loyalty Program should be referred to the store manager or emailed to marketing@kellyvillepets.com.au.
• A copy of the current Terms and Conditions can be obtained online at www.kellyvillepets.com.au, and our Privacy Policy is available on our website.

The promoter of the Pet Lovers Club Loyalty Program is Petopia Pty Ltd T/as Kellyville Pets Pty Ltd (ABN 50 151 314 448), which is also the owner of the scheme. Kellyville Pets Pty Ltd is located at PO Box 6006, Rouse Hill Town Centre NSW 2153.

Any alleged discrepancy in relation to earned points must be notified in writing by a Member to Kellyville Pets, together with a legible copy of any relevant record of purchase (for example, a tax invoice). Kellyville Pets will investigate such discrepancies but reserves the right to be the final arbiter in the event of any dispute. In case of dispute, the decision of Kellyville Pets shall be final and binding.

Kellyville Pets further reserves the right to adjust the points balance retrospectively in the event of incorrect entries, whether due to Kellyville Pets' error or otherwise.

All questions or disputes regarding eligibility for the Loyalty Program, or the eligibility of points for accrual or redemption, or any other dispute arising in connection with a Member's participation in the Loyalty Program, will be resolved by Kellyville Pets in its sole discretion.
